1. Scope and parties
These terms govern the use of architectcommerce.com, the client portal, the free Potential Analysis and the paid Omnichannel Audit. The services are offered to businesses — brands, manufacturers, retailers, agencies and their advisers. By requesting an analysis you confirm that you act in a commercial capacity.
- Provider
- ARCHITECT Commerce, Inc.
2. The free Potential Analysis
- The Potential Analysis is an automated survey of publicly accessible sources for one brand in one market: channel presence with evidence URLs, cited market reference figures and a directional estimate of the gap between the brand's current and benchmark performance.
- It is free of charge and creates no obligation on either side. It requires a client account.
- Our team approves the scope before a crawl runs. We may decline, delay or cap requests, including a daily limit per requester, without giving reasons.
- Every analysis passes an automated quality gate before release. It is delivered in the client portal and through a read-only share link; the release e-mail links the live document.
- The sample analysis linked from the site is example data and is labelled as such.
3. Four standing limits
Every analysis is delivered subject to the four limits printed on it:
- 01 Presence, not absence — a machine can prove a product is listed somewhere, never that it is listed nowhere. “Not found” never means “not present”.
- 02 Count, not quality — machines count what is on a page. Every statement about quality, awareness or reputation carries a person behind it.
- 03 Directional market figures — market sizes and growth rates are cited, directional context, never precision forecasts.
- 04 Proposes, never spends — the engine recommends; a person approves every spend.
4. No warranty for the free analysis
The Potential Analysis is provided as is. We do not warrant its accuracy, completeness or timeliness, nor its fitness for a particular purpose. Figures are directional. Sources are third-party websites that change without notice; evidence is quoted as retrieved on the date the analysis states. The analysis is not legal, financial or investment advice and does not replace your own due diligence.
5. The paid Omnichannel Audit
The Omnichannel Audit is an analyst-led engagement. On request we provide a quote; scope, modules, deliverables, timeline, price, payment and acceptance are set out in a statement of work or order confirmation agreed for the engagement. That document governs the engagement and prevails over these terms where they differ. Nothing on the website is a binding offer or a price.
6. Accounts and share links
Keep your sign-in credentials confidential; actions taken under your account are attributed to you. A share link opens the analysis to anyone who holds it, without a login — pass it on only to people who may read the document. We may rotate, expire or revoke share links.
7. Use of deliverables
You may use an analysis for your own business purposes and share it with your advisers and partners. You may not resell it, publish it as your own market research or systematically extract its data for a competing service. Structure, method and wording of the analyses remain ours; brand, product and store names remain the property of their owners.
8. The public store directory
The directory pages publish observations read from public storefront catalogues. They are information, not statements about the operators of those stores, and carry no warranty. Corrections and objections are handled as described in the privacy policy.
9. Liability
For services provided free of charge we are liable only for intent and gross negligence. This does not limit liability for injury to life, body or health, or any liability that cannot be limited under mandatory law. For paid engagements, liability is governed by the statement of work and statutory law.
Liability clause to be reviewed by counsel for the operating entity's jurisdiction.
10. Availability and changes to the service
We make no availability commitment for the free services and may change, suspend or discontinue them. Paid engagements are governed by their statement of work.
11. Governing law and jurisdiction
- Governing law, venue
- Laws of the State of California, USA, without regard to its conflict-of-law rules; exclusive venue the state and federal courts of Los Angeles County, California (as in the ARCHITECT platform agreements). Mandatory consumer-protection and data-protection law of your country of residence remains unaffected.
12. Final provisions
Should a provision of these terms be invalid, the remaining provisions stay in force. The version date is shown at the top of the page; the current version applies to new requests.
